Cochrane planning board approves consent to merge land with 461 Eighth Street; appeals due Oct. 29

The Cochrane and Suburban Planning Board approved a consent application from CGV Developments to convey land that will merge with 461 Eighth Street in Cochrane, following an Oct. 8, 2025 hearing. The conditional approval was issued under Section 53 of Ontario’s Planning Act, and the last day to appeal is Oct. 29, 2025.

The decision allows a parcel to be merged with the existing Eighth Street property and sets a two-year window to complete required conditions. If no appeal is filed by the deadline, the consent becomes final under the Act.

The board considered Section 53 of the Planning Act, the Town of Cochrane Official Plan, the characteristics of the land and its surroundings as addressed in a planning report dated Sept. 26, 2025, correspondence received, and information presented at the Oct. 8 hearing.

The approval is subject to three conditions: payment of any outstanding municipal taxes and other charges on both the lot to be severed and the lot to be retained; submission of a copy of the registered survey of the severed lot prepared by an Ontario Land Surveyor; and merger of the conveyed lands with the benefitting lands at 461 Eighth Street.

Once all conditions are fulfilled within two years and all authorities have notified the board in writing, the Secretary-Treasurer is authorized to issue a certificate under subsection 53(42) of the Planning Act. The Planning Board will issue no further notice or warning of the two-year expiration. If conditions are not fulfilled within that time and the proponent wishes to proceed, a new application and fee will be required.

Appeals may be made to the Ontario Land Tribunal by individuals, corporations, or public bodies by filing a notice of appeal with the Secretary-Treasurer of the Cochrane and Suburban Planning Board and paying the prescribed fee. Unincorporated associations cannot file appeals directly, though a member may file on an association’s behalf. Any person or public body may, no later than 20 days after notice under subsection 53(17) is completed, appeal the decision or any condition. If no appeal is filed under subsections 53(19) or 53(27), and subject to subsection 53(23), the decision to give or refuse provisional consent is final.

The application number is B2025-08. A certified copy of the notice of decision was mailed to the applicant on Oct. 9, 2025.
