Ontario Proposes Changes to Bail System for Repeat Violent Offenders
The Ontario government announced proposed legislation on June 6, 2024, that would introduce changes to the province's bail system. According to the government, the bill is intended to address concerns about repeat violent offenders.
If enacted, the legislation would expand the list of criminal offences that require an accused person to provide reasons for release on bail. Offences identified include possession of loaded prohibited or restricted firearms and violent crimes. The government stated that courts would be required to consider a person's history of violence when determining bail eligibility.
Government officials present at the announcement included Associate Minister of Women's Social and Economic Opportunity Charmaine Williams, Solicitor General Michael Kerzner, and Attorney General Doug Downey. Statements from these officials indicate that the proposed changes are intended to "protect communities from repeat violent offenders."
The Ontario government noted that most pre-trial bail decisions are governed by federal law, but these proposed changes would affect the provincial framework. The bill will be subject to legislative debate before any provisions take effect.
